Net Sales, Defined Provision

The term “net sales” means monies actually received by the company in payment of billings within 90 days from the date of the billing and shall not include any monies obtained as a result of efforts of any collection agency or attorneys. “Net sales” shall be calculated only with respect to sales occurring after the date of the commencement of the term of this agreement and before the expiration or sooner termination thereof. Upon final settlement following the cessation of your services hereunder, your commission shall be based on the net sales from sales obtained by you, subject to the provisions of this agreement.

General information, not legal advice. Treat this as a drafting starting point, not a finished policy — employment law varies by jurisdiction and changes often, so have a licensed attorney tailor it to your situation before you rely on it.
