Possession of Unlawful or Stolen Material Policy

At times, the Company may become aware of situations reported by employees when co-workers may possess or take ownership of unapproved or unlawful materials. The Company reserves the right to search the possessions of employees including their person, lockers, automobiles or other items located on Company property. Employees are given advance written notice of this policy so that they should not expect privacy in these areas or items while on Company property. Some states further restrict the scope of permissible searches, including searches of personal vehicles; the Company will conduct any search in accordance with the law of the state where the employee works.

Either you or the Company may request to have police present for a search of your body. The Company doesn’t require law enforcement unless there is a specific reason to do so and will always have at least two managers present during a search. An employee may refuse a search, however this may result in termination.

General information, not legal advice. Treat this as a drafting starting point, not a finished policy — employment law varies by jurisdiction and changes often, so have a licensed attorney tailor it to your situation before you rely on it.
